[Battlemesh] exception for free software?

Hi,

During the FCC presentation, William mentioned that "an exception for
free software" is not really possible:

https://fsfe.org/activities/radiodirective/statement.en.html

"make general exceptions for all Free Software not developed by the
manufacturers of the respective radio equipment themselves but from
other companies or individuals."

I tend to agree that an exception for Free Software is not really what
should be fought for, because that raises the legal question of the
definition of what is Free Software, and why there should be an
exception for certain kind of software and not for other kinds of
software.

And an exception for consumer electronics is not realistic neither,
since they are the prinary target.

What is the solution then?

Best,

"In July 2005, after several failed attempts to legalise software
patents in Europe, the patent establishment changed its strategy.
Instead of explicitly seeking to sanction the patentability of
software, they are now seeking to create a central European patent
court, which would establish and enforce patentability rules in their
favor, without any possibility of correction by competing courts or
democratically elected legislators."
